1. Acceptance of Terms
By accessing or using South Facing Garden (the “Service”), available at app.southfacinggarden.co.uk and via our mobile applications, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
These terms constitute a legally binding agreement between you and Gulliver Consultations Ltd (“we”, “us”, “our”).
2. What the Service Provides
South Facing Garden provides Property Intelligence Reports for UK residential addresses. These reports draw on publicly available data sources including UK Government APIs, Land Registry, Police.uk, Ofsted, Ofcom, Environment Agency, and Ordnance Survey data.
All reports are provided for informational purposes only. The Service does not constitute professional advice of any kind, including but not limited to surveying advice, legal advice, financial advice, or conveyancing advice.
You should always obtain independent professional surveys, legal searches, and specialist assessments before making any property purchasing decision. South Facing Garden reports are designed to assist preliminary research and should not be relied upon as a substitute for professional due diligence.
Data accuracy depends on third party sources and we cannot guarantee that all data is complete, current, or accurate for every address.
3. Free and Pro Tiers
Free tier: New users receive three free Property Intelligence Reports at no cost. No account or payment details are required. The free allowance resets on a rolling 30-day basis per device.
Pro subscription: A Pro subscription is available at £4.99 per month. Pro subscribers receive unlimited Property Intelligence Reports plus additional features including saved properties, property comparison, and shareable report links.
Pro subscriptions are billed monthly and renew automatically until cancelled. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period and you will not be charged for the following month. No refunds are provided for partial billing periods.
Subscription management and billing is handled by Apple (via the App Store) or Google (via Google Play) depending on your platform. Web billing is handled by our payment provider. We do not store your payment card details.
4. Acceptable Use
The Service is provided for personal, non-commercial property research purposes only. You agree not to:
— Scrape, extract, or systematically download data from the Service by automated means;
— Resell, sublicense, or redistribute Property Intelligence Reports or any data obtained through the Service;
— Use the Service to build a competing product or service;
— Attempt to reverse engineer, decompile, or extract the underlying data sources or algorithms;
— Use the Service in any way that violates applicable law or regulation;
— Misrepresent data from our reports as your own original research.
Professional use by estate agents, mortgage brokers, surveyors, or other property professionals is permitted only under a separate professional or estate agent agreement with us.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Gulliver Consultations Ltd shall not be liable for any loss or damage arising from your use of, or reliance upon, the Service or any Property Intelligence Report.
In particular, we are not liable for any loss arising from:
— Decisions made in connection with the purchase, sale, or rental of any property based on information provided by the Service;
— Inaccuracies, errors, or omissions in third party data used to generate reports;
— Temporary unavailability of the Service;
— Changes to data made by third party data providers after your report was generated.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by English law.
6. Intellectual Property
All content, design, software, and functionality of the Service — including but not limited to the South Facing Garden name, logo, report design, scoring methodology, and written content — is owned by or licensed to Gulliver Consultations Ltd and is protected by copyright and other intellectual property laws.
Underlying data used in reports remains the property of the respective data providers (UK Government, Ordnance Survey, Land Registry, etc.) and is subject to their own licensing terms.
You may not reproduce, copy, distribute, or create derivative works from any part of the Service without our prior written consent.
7. Changes to These Terms
We may update these Terms of Service from time to time. We will indicate the date of the most recent update at the top of this page. Continued use of the Service after any changes constitutes your acceptance of the updated terms.
For material changes, we will endeavour to provide reasonable notice via the app or by email where we hold your contact details.
8. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
